1. Acceptance of Terms
By accessing or using WinProposal ("the Service"), you confirm that you are at least 18 years old, have read and understood these Terms of Service ("Terms"), and agree to be bound by them. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, please do not use the Service.
2. Description of Service
WinProposal is a subscription-based software-as-a-service (SaaS) platform that uses artificial intelligence to assist freelancers in generating personalized job application proposals. The Service is designed to help improve the quality, tone, and relevance of proposals across platforms including Upwork, Fiverr, Toptal, and LinkedIn.
Important: WinProposal is a writing assistance tool. We do not guarantee any specific outcome, response rate, or job offer as a result of using the Service. Results depend on many factors outside our control.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice provided where practicable.
3. Account Registration
To use WinProposal, you must create an account and select a paid subscription plan. You agree to:
- Provide accurate and complete registration information
- Maintain the security and confidentiality of your login credentials
- Notify us promptly at support@winproposal.io if you believe your account has been compromised
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or attempt to circumvent subscription limits.
4. Subscriptions and Billing
WinProposal offers three paid subscription plans, processed by our payment provider Paddle Billing:
- Starter — $9/month · 30 proposals per month
- Pro — $19/month · 120 proposals per month
- Agency — $49/month · Unlimited proposals
All plans are billed monthly. Subscriptions renew automatically at the end of each billing period unless cancelled. Paddle, as the Merchant of Record, is responsible for processing your payment and handles all billing inquiries on our behalf.
Proposal usage counters reset on the first day of each calendar month. Unused proposals do not carry over. If you reach your monthly limit before the reset date, proposal generation will be paused until the following billing cycle or until you upgrade your plan.
You may cancel your subscription at any time through your account dashboard. Cancellation stops automatic renewal; you retain access to the Service until the end of the current paid billing period. No partial-month refunds are issued for cancellations, except where required by applicable law or as described in our Refund Policy.
5. Acceptable Use
You agree to use WinProposal only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Service to generate content that is fraudulent, misleading, or designed to deceive clients or employers
- Submit false information about your experience, credentials, or work history to the AI generation system
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service
- Circumvent, disable, or otherwise interfere with security features of the Service
- Use automated scripts or bots to interact with the Service in place of genuine human use
- Share or resell access to your subscription
- Upload content that infringes third-party intellectual property rights
6. Intellectual Property
Your content: You retain all ownership rights to the input content you provide to WinProposal (job descriptions, profile information, portfolio data). By submitting content, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing the Service to you.
Generated proposals: The proposals generated through WinProposal, once delivered to you, are yours to use freely.
Our platform: WinProposal, its design system, software, and underlying technology remain the exclusive property of WinProposal, Inc. Nothing in these Terms transfers ownership of our intellectual property to you.
7. AI-Generated Content
WinProposal uses large language models (including Anthropic's Claude API) to generate proposal content. You acknowledge that:
- AI-generated proposals are starting points and writing aids — they are not a substitute for your own judgment and professional knowledge
- You are solely responsible for reviewing, editing, and submitting any proposal generated through the Service
- AI outputs may occasionally be inaccurate, incomplete, or unsuitable for a specific application — always review before sending
8. Privacy and Data
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
In plain terms: WinProposal is designed to help you write better proposals. We cannot promise that using it will result in more responses, interviews, or job offers.
10. Limitation of Liability
To the maximum extent permitted by applicable law, WinProposal, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
11. Termination
You may terminate your account at any time by cancelling your subscription through the account dashboard and contacting us at support@winproposal.io.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice in the Service before the changes take effect.
